Our Binding Financial Agreement Lawyers will always begin your journey with an initial consultation.
We have a large number of clients come to us for prenuptial and cohabitation agreements that, once we complete the initial consultation, can advise to look at better and more appropriate asset protection options available, often referring those clients out to specialists in estate planning and commercial or property law.
This is important, because there are substantial risks that parties can be open to through these agreements if they are not done correctly and appropriately, and it is our role to assess the risks against the likely advantages to each client in their own individual circumstances
Already separated?
For those Brisbane couples who have already separated, we will only look to Binding Financial Agreements on a limited number of occasions. It is our view that financial matters are best resolved under the seal of the court, and this can be done using consent orders.
One example is where the agreement between the parties would not meet the ‘just and equitable’ test in the courts, but the parties are adamant that this is the resolution they are seeking, we may consider it appropriate for them to enter into a Binding Financial Agreement. This would still allow for the stamp duty and tax concessions that can be granted under family law exceptions, and allow families to move forward with their lives.

We imagine each agreement to be a boat, ensuring it stays afloat.
We know that clients can find template agreements online, as well as other practitioners who provide this service at a much lower cost. At JP Family Law & Mediation, we invest substantial time, experience and skill into working to ensure that your Binding Financial Agreements not only meets your intended needs, but is as secure and effective under the scrutiny of the law to prevent your investment being undone in the future.
We like to imagine each agreement as though it were a boat, and we need to plug every, single, possible hole in that vessel to ensure it stays afloat. We draft, review, and draft and review again before we send it out. It is an investment, but we won’t recommend it unless it is valuable to you.
